Rules for registration of the date and time of arrival of goods in the customs zone of the Eurasian Economic Union.

Rules for fixing the date and time of notification of the arrival of goods into the customs territory of the Eurasian Economic Union.

In accordance with paragraph 4 of Article 154 of the Code of the Republic of Kazakhstan dated December 26, 2017 "On Customs Regulation in the Republic of Kazakhstan" (hereinafter referred to as the Code), Order No. 216 of the Minister of Finance of the Republic of Kazakhstan dated February 16, 2018 approved the "Rules for fixing the date and time of notification of the arrival of goods into the customs territory of the Eurasian Economic Union", which defines the procedure for recording by authorized officials of state revenue bodies located at the places of arrival (hereinafter – authorized official), the date and time of notification of the arrival of goods into the customs territory of the Eurasian Economic Union (hereinafter referred to as the EAEU).

 After the arrival of goods into the customs territory of the EAEU, the carrier is obliged to notify the customs authority of the arrival of goods into the customs territory of the EAEU by submitting documents and information for international carriage by road:

      documents for an international transport vehicle;

      transport (transportation) documents;

      documents accompanying international postal items during their transportation, as defined by the acts of the Universal Postal Union;

      the commercial documents available to the carrier for the goods being transported;

       information about (about):

      state registration of an international transportation vehicle;

      the carrier of the goods (name and address);

      the country of departure and the country of destination of the goods (names);

      the sender and recipient of the goods (names and addresses);

      the seller and the buyer of the goods in accordance with the commercial documents available to the carrier;

       the number of cargo packages, their labeling and types of packaging of goods;

      goods (names and codes of goods in accordance with the Harmonized Commodity Description and Coding System or the Commodity Nomenclature of Foreign Economic Activity at the level of at least the first six characters);

      gross weight of goods (in kilograms) or volume of goods (in cubic meters);

      the presence (absence) of goods whose import into the customs territory of the Eurasian Economic Union is prohibited or restricted;

      place and date of preparation of the international consignment note;

      identification numbers of containers, by road, – within one hour from the moment of delivery of goods to the place of arrival, and in the case of delivery of goods to the place of arrival outside the working hours of the customs authority – within one hour from the time of the beginning of the work of the customs authority.

     It is allowed to submit documents and information on behalf of the carrier by a customs representative or other persons acting on behalf of the carrier.

      The documents are submitted on paper or in the form of an electronic document.

      After the carrier, customs representative or other persons acting on behalf of the carrier have submitted documents and information, an authorized official ensures the reception, verification and registration of the arrival notification.

      After completing the verification of the availability of documents and information, the authorized official registers the arrival notifications.

      Registration of the arrival notification is carried out in the log of registration of notifications of arrival of goods to the customs territory of the EAEU in the approved form

       The registration number of the notification of arrival at the customs territory of the EAEU, as well as the date and time of registration, are affixed to the first sheets of transport (transportation) and commercial documents, or on a document containing information about the registration number of preliminary information provided in the form of an electronic document, which are certified by the signature and imprint of the personal numbered seal of an authorized official.

       If the documents are submitted in the form of an electronic document, information about the registration number of the arrival notification, as well as the date and time of registration, are sent to the information system of the person who submitted such documents.

If the information systems of the state revenue authorities allow registration of the arrival notification through information systems, keeping a paper Registration Log is not required. At the same time, the registration of the arrival notification is carried out using the information systems of the state revenue authorities.

The carrier or other persons acting on behalf of the carrier, within three hours of the customs authority's working time from the moment of notification of the arrival of goods, are obliged to perform one of the customs operations related to:

placing goods in temporary storage;

      transportation (transportation) of goods from the places of arrival to the place of temporary storage in accordance with the procedure established by legislation;

      customs declaration of goods;

      by placing goods under the customs procedure of a free customs zone on the territory of a port FEZ or a logistics FEZ;

      export of goods from the customs territory of the EAEU.
